Terms of Service

1. Introduction and Acceptance

1.1. These Terms of Service (these "Terms") are a legally binding agreement between you and KOncierge Corp. (주식회사 콩시어지), a company incorporated under the laws of the Republic of Korea (the "Company", "KOncierge", "we", "us", or "our"). These Terms govern your access to and use of:

  • the websites operated by the Company, including koncierge.kr and its subdomains and localized versions (the "Website");
  • the KOncierge Concierge Agent, our travel concierge service available on the Website and through messaging applications including LINE and WhatsApp;
  • the KOncierge guide marketplace, through which travelers can discover and book independent licensed tour guides;
  • travel products organized and sold directly by the Company as a registered travel agency ("KOncierge Travel"); and
  • all related content, features, tools, community boards, and services we make available (together, the "Services").

1.2. By creating an account, clicking to accept, making a purchase, sending a message to the Concierge Agent, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1.3. The following documents are incorporated into these Terms by reference and form part of your agreement with us:

  • our Privacy Policy;
  • our Refund Policy;
  • any product-specific terms, cancellation policies, participation requirements, or restrictions displayed on a product page or booking flow before you complete a purchase; and
  • any community guidelines, campaign terms, or feature-specific terms we publish within the Services.

If a product-specific term conflicts with these Terms, the product-specific term prevails for that product to the extent of the conflict. Nothing in any incorporated document reduces your mandatory rights under applicable consumer protection law.

2. Definitions

In these Terms:

  • "Member" means a person who has registered an account for the Services, whether via the Website or by linking a messaging channel profile.
  • "Traveler" means a Member or other individual who browses, books, or participates in travel products through the Services.
  • "Guide" means an independent tour guide who holds the licenses required under Korean law (including, where applicable, a tourist guide qualification under the Tourism Promotion Act) and offers guiding services or tours through the marketplace. Guides are independent businesses and are not employees, agents, or partners of the Company.
  • "Concierge Agent" means the Company's travel concierge service, consisting of (a) an automated chat assistant powered by artificial intelligence (the "AI Concierge") and (b) live sessions with the Company's human concierge staff ("Human Sessions").
  • "Credits" means the prepaid units issued by the Company that may be used to access designated paid features of the Services, as described in Section 15.
  • "Plan" means a recurring subscription product that includes Credits and/or member benefits, billed on a periodic basis.
  • "Marketplace Product" means a tour, activity, or guiding service offered for sale by a Guide through the Services, whether as a listed curated tour or as a custom tour formed on a Guide's accepted proposal.
  • "KOncierge Travel Product" means a travel product organized and sold by the Company itself under its travel business registration.
  • "Booking" means a confirmed reservation of a Marketplace Product or KOncierge Travel Product.
  • "User Content" means any content a Member submits to the Services, including reviews, board posts, comments, photos, and messages posted in public or community areas.

3. Changes to These Terms

3.1. We may amend these Terms from time to time, for example to reflect changes in the Services, our business, or applicable law.

3.2. If a change is disadvantageous to Members (for example, new fees, reduced Member rights, or expanded Member obligations), we will announce it through the Services and/or notify you by email or your linked messaging channel at least 30 days before it takes effect. Other changes will be announced at least 7 days in advance.

3.3. If you do not agree to an amendment, you may stop using the Services and close your account before the amendment takes effect; any unused paid Credits will be handled in accordance with the Refund Policy. If you continue to use the Services after the effective date of an amendment, and we stated this consequence in the notice, you are deemed to have accepted the amended Terms.

3.4. The date at the top of this page shows when these Terms were last revised. Earlier versions are available from us on request.

4. Eligibility

4.1. You must be at least 14 years of age to create an account.

4.2. If you are a minor under the law of Korea (under 19 years of age) or of your place of residence, you may purchase paid products or participate in tours only with the consent of a parent or legal guardian, and product pages may impose additional minimum-age or accompaniment requirements.

4.3. By using the Services you represent that: (a) you have the legal capacity to enter into these Terms; (b) the registration information you provide is true, accurate, and current; (c) you are not prohibited from using the Services under applicable law; and (d) you will use the Services for your own personal, non-commercial purposes, unless we have expressly agreed otherwise in writing (for example, under a separate Guide or partner agreement).

4.4. We may refuse, condition, or revoke registration where: an application uses another person's identity or false information; the applicant previously lost membership due to a violation of these Terms; or acceptance is impracticable for technical or legal reasons. Where we refuse or condition registration, we will inform the applicant unless prohibited by law.

5. Accounts and Security

5.1. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you, except to the extent caused by our fault.

5.2. You must notify us promptly if you become aware of any unauthorized use of your account or any other breach of security. We are not liable for losses arising from unauthorized use that occurs before you notify us, except to the extent caused by our fault.

5.3. One person may maintain only one account. You may not sell, transfer, lend, or share your account, Credits, or Member benefits with any other person.

5.4. You agree to keep your registration information (including email address and phone number) accurate and up to date. Notices sent to the contact details registered to your account are deemed delivered to you; you bear any disadvantage caused by failing to update your details.

6. Cross-Channel Account Linking

6.1. The Services operate across multiple channels: the Website and messaging applications including LINE and WhatsApp. If you have previously chatted with the Concierge Agent on a messaging channel and later register a Website account using an email address or phone number that matches the record we hold, we automatically link the two records so that your prior conversations (in read-only form), Credits, Bookings, and account standing are recognized as yours across channels.

6.2. This linking is a mandatory part of how the Services function; we cannot provide the unified platform experience without it. You are informed of the linking at the point of registration, which is when the match, if any, is made.

6.3. If a link is made in error — for example, because a phone number was previously assigned to a different person — you may request an unlink at any time by contacting support, and we will promptly separate the records once verified. Further details are set out in our Privacy Policy.

7. The Services

7.1 AI Concierge

The AI Concierge is an automated chat assistant that answers travel questions, helps you plan, and assists you in using the Services. AI chat is provided free of charge and does not consume Credits. The AI Concierge is subject to the disclaimers in Section 19.

7.2 Human Sessions

Human Sessions connect you with the Company's concierge staff for personalized assistance (for example, planning help, reservations assistance, or on-trip support). Human Sessions consume Credits at the rate displayed before you confirm the session. The scope of what concierge staff can and cannot do (for example, which third-party reservations we can make on your behalf) is described within the Services and may change over time.

7.3 Guide Marketplace

The marketplace connects Travelers directly with licensed Guides. Each Guide independently designs and operates their own tours based on their expertise and local knowledge — the Guide, not a standardized package, is the core of the product. Travelers can use the marketplace in two ways:

  • Curated tours. Booking an interest-based tour listed by a Guide (for example, K-POP, K-beauty, food, night views, or filming-location themes). Listings — including itineraries, prices, inclusions, exclusions, meeting points, group sizes, languages, and cancellation policies — are created by the Guide, who is responsible for their accuracy.
  • Custom tour requests. Requesting a 1:1 custom itinerary from a Guide. The Guide prepares a proposal through the Services — itinerary, duration, price, inclusions, and any special conditions — and the proposal you accept at booking constitutes the product description and terms for that Booking.

Pre- and post-booking communication with Guides takes place through the Services so that the agreed scope of each Booking is recorded.

7.4 KOncierge Travel

KOncierge Travel Products are organized and sold by the Company under its travel business registration. For these products the Company is the seller and is responsible for the product as described at the time of purchase.

7.5 Community

The community area includes the blog, community board, and travel tools. Community features are provided for information-sharing among travelers and are subject to Sections 21–23.

7.6 Changes to the Services; Beta Features

We continuously develop the Services and may add, modify, or discontinue features. We will give reasonable prior notice of changes that materially and adversely affect paid features, and paid amounts affected by a discontinued feature will be handled under the Refund Policy. Features labeled beta, preview, or experimental are provided for evaluation, may be modified or withdrawn at any time, and are excluded from service-level commitments to the maximum extent permitted by law.

7.7 Service Availability

We aim to provide the Services 24 hours a day, year-round, but availability may be interrupted for maintenance (announced in advance where practicable), emergencies, telecommunications failures, or events beyond our reasonable control. Human Sessions are available during the operating hours displayed in the Services.

7.8 What the Services Are Not

At your request, the Concierge Agent may assist with practical arrangements such as making appointments or reservations, including at clinics. However, the Company does not provide medical treatment or medical advice, does not recommend, broker, or receive compensation for introducing you to any specific medical institution or procedure, and the Services are not a substitute for professional medical care. Nothing in the Services constitutes legal, medical, financial, immigration, or other professional advice.

8. Role of the Company; Marketplace Intermediary Status

8.1. For Marketplace Products, the Company acts as an intermediary of mail-order sales (통신판매중개자) within the meaning of the Act on Consumer Protection in Electronic Commerce (Korea) and is not a party to the transaction between the Traveler and the Guide. When a Booking of a Marketplace Product is confirmed, a contract for the tour service is formed directly between you and the Guide. The Guide is the seller and bears responsibility for the description, quality, and performance of the Marketplace Product, and carries primary responsibility for on-site safety management during the tour. In accordance with Korean law, we display this status and the identity of the Guide as seller before purchase.

8.2. The Company operates the platform: hosting listings, facilitating matching and communication, processing payments as a payment collection agent for the Guide, providing customer support channels, and administering the Refund Policy. Payment you make through the platform for a Marketplace Product discharges your payment obligation to the Guide to the extent of the amount paid. Likewise, all cancellations and refunds are requested from and processed by the Company through the platform — eligible refunds are paid to you by the Company first, and the Company settles separately with the Guide, so you never need to pursue a Guide directly for a refund.

8.3. For KOncierge Travel Products, the Company is the seller (통신판매업자) and a registered travel business under the Tourism Promotion Act, and is responsible for those products accordingly.

8.4. Whether a given product is a Marketplace Product or a KOncierge Travel Product is indicated on the product page and/or in the Booking confirmation.

9. Guide Verification and Standards

9.1. Before activation, every Guide undergoes government-license verification (a valid tourist guide qualification under the Tourism Promotion Act, 관광통역안내사) and identity verification, and enters a written agreement with the Company under which the Guide warrants the validity of their qualifications and the accuracy of their product information, and commits to platform service standards and compliance with applicable law.

9.2. Under that agreement, Guides bear primary responsibility for safety management on site, must follow defined accident-response procedures, and must notify us without delay of any incident or of the loss or suspension of their qualification. For tour types we designate as higher-risk, Guides are required to maintain appropriate insurance as a condition of offering the product.

9.3. Guides are contractually prohibited from, among other things: presenting themselves as the Company or holding the Company out as the travel agency for their Marketplace Products; issuing documents in the Company's name; manipulating reviews or ratings; and using the KOncierge brand without authorization.

9.4. After activation, Guides are subject to ongoing quality monitoring through verified reviews, booking and activity records, and traveler feedback, and 24/7 traveler support is available through the Concierge Agent before and during tours.

9.5. Verification and monitoring are diligence measures, not a guarantee of any particular tour outcome, and inclusion on the platform is not an endorsement of every statement a Guide makes. You can report concerns about a Guide through support channels at any time; we investigate reports and may suspend or remove Guides who breach platform standards.

10. Bookings

10.1. A Booking is formed when (a) you submit a complete booking request, (b) payment (in money, Credits, or a combination) is authorized, and (c) we or the Guide issue a booking confirmation. For products marked as requiring seller confirmation, no contract exists until the confirmation is issued; if confirmation is not issued within the stated window, your payment is released or refunded in full. For custom tour requests, the Booking is formed on the Guide's proposal that you accept, and the accepted proposal (itinerary, duration, price, inclusions, and conditions) constitutes the product description for that Booking.

10.2. You are responsible for reviewing your Booking details — dates, times, participant names and counts, options, meeting points, and contact information — both at checkout and in the confirmation, and for telling us promptly about any error. Losses caused by inaccurate information you provided may not be recoverable.

10.3. Itineraries may be adjusted in minor ways (order of stops, equivalent substitutions) for operational reasons, weather, traffic, or venue closures, provided the overall character and value of the product is preserved. Material changes entitle you to the remedies in the Refund Policy.

10.4. Some products have minimum participant numbers, age limits, health or fitness requirements, or equipment requirements; these are stated on the product page and are conditions of participation.

10.5. Communications about a Booking should be conducted through the Services (web chat, LINE, or WhatsApp) so that a record exists in case of dispute.

11. Traveler Responsibilities

You agree that you (and each member of your party) will:

11.1. hold valid passports, visas, and any documents required for your travel, and comply with Korean immigration, customs, and local laws — obtaining these is your responsibility, and denial of entry or boarding is not attributable to the Company or a Guide;

11.2. arrive at designated meeting points on time; late arrival may result in the tour departing without you, which is treated as a no-show under the Refund Policy unless the delay was caused by the Guide or the Company;

11.3. disclose, at or before booking, any health conditions, dietary restrictions, accessibility needs, or other circumstances of your party that are reasonably necessary for safe participation, so that suitability and reasonable accommodations can be assessed;

11.4. supervise minors in your party at all times; Guides do not provide childcare;

11.5. follow the reasonable safety instructions of Guides, drivers, and venue staff, and refrain from intoxicated, dangerous, harassing, or unlawful behavior. A Guide or the Company may refuse or terminate participation, without refund, where a participant's behavior endangers any person, materially disrupts the experience of others, or violates law or venue rules;

11.6. respect local customs and rules at religious sites, markets, and residential areas, and obtain consent before photographing identifiable individuals;

11.7. bear personal expenses not listed as included (meals, admission, transport, gratuities, personal purchases), and arrange your own travel insurance appropriate to your trip. We strongly recommend that all Travelers carry travel insurance covering medical care, evacuation, and trip interruption.

12. Assumption of Risk

Travel and outdoor activities involve inherent risks — including transportation incidents, terrain hazards, weather, wildlife, food-related illness, and the acts of third parties — that can result in injury, illness, property damage, or death, and that cannot be eliminated even with reasonable care. To the extent permitted by law, you voluntarily assume the inherent risks of the activities you choose to book. This Section does not exclude any liability of the Company or a Guide arising from intentional misconduct or negligence, or any liability that cannot be excluded by law.

13. Prices, Taxes, and Currency

13.1. Prices are displayed in Korean Won (KRW) unless otherwise indicated, and include Korean VAT where applicable. Where prices are shown in another currency for convenience, the KRW price at checkout is definitive unless expressly stated otherwise.

13.2. Prices may change at any time before purchase; changes do not affect Bookings already confirmed.

13.3. If a price displayed is manifestly erroneous (for example, due to a technical fault) such that a reasonable person would recognize the error, we or the Guide may cancel the affected order with a full refund of any amount paid.

13.4. If you pay with a payment method denominated in a currency other than KRW, your payment provider determines the exchange rate and may charge foreign transaction fees. Those rates and fees are outside our control, both for payments and refunds.

14. Payments

14.1. Payments are processed by licensed third-party payment providers (currently Toss Payments for Korean and international cards, and PayPal). Your use of a payment provider is subject to that provider's own terms and privacy policy.

14.2. You represent that you are authorized to use the payment method you provide. We may cancel transactions, withhold delivery, and/or suspend accounts where we reasonably suspect fraud, unauthorized card use, money laundering, or abuse.

14.3. Receipts and tax invoices (including cash receipts under Korean tax law, where applicable) are issued in accordance with applicable law and the options offered at checkout.

14.4. The Company does not store full card numbers on its own systems; card data is handled by the payment providers.

15. Credits

Credits and Credit packs are not currently offered for purchase. This Section applies from the date the Company launches Credit products; until then, no provision of this Section creates any right or obligation.

15.1. Nature of Credits. Credits are a prepaid means of accessing designated paid features of the Services — currently, Human Sessions and any other features expressly priced in Credits. Credits are not electronic money or a deposit, have no cash value outside the Services, do not accrue interest, and may not be transferred between accounts, sold, exchanged, or used for any purpose other than those we designate.

15.2. Purchase. Credits may be obtained by purchasing one-time Credit packs, through Plans, or as bonus Credits granted in promotions. The price, Credit amount, and any bonus portion are displayed before purchase.

15.3. Consumption. The Credit cost of each paid feature is displayed before you confirm use. Credits are deducted upon confirmed delivery of the relevant service (for example, when a Human Session is provided). The AI Concierge never consumes Credits.

15.4. Order of use. Where you hold both bonus and paid Credits, bonus Credits are consumed first, and within each category, Credits closest to expiry are consumed first.

15.5. Expiry. Paid Credits are valid for 5 years from the date of purchase, consistent with the extinctive prescription period under the Korean Commercial Code. Bonus or promotional Credits may carry shorter validity periods, stated when they are granted. Expired Credits are extinguished and cannot be restored, except where mandatory law provides otherwise.

15.6. Balance and records. Your current Credit balance and transaction history are available in your account. If you believe there is an error in your balance, contact support within a reasonable time and we will investigate and correct verified errors.

15.7. Refunds. Refunds of Credits are governed exclusively by the Refund Policy.

15.8. Adjustments for wrongdoing. We may cancel or claw back Credits obtained through fraud, abuse of promotions (including multiple accounts), or system error, after notifying you of the reason.

16. Plans and Auto-Renewal

Plans (auto-renewing subscriptions) are not currently offered. This Section applies from the date the Company launches Plan products; until then, no purchase renews automatically and no recurring charge is authorized or made. Currently offered concierge access products (day passes, Complete Access, and Lifetime Premium) are one-time purchases governed by Section 7, Section 14, and the Refund Policy.

16.1. Plans renew automatically at the end of each billing cycle at the then-current price until cancelled. By subscribing, you authorize recurring charges to your chosen payment method.

16.2. You may cancel a Plan at any time through your account settings or support; cancellation stops the next renewal and the Plan remains active until the end of the current paid cycle.

16.3. We will notify you in advance of any increase in the renewal price or material reduction in Plan benefits, within the notice periods in Section 3. If you do not accept the change, you may cancel before it takes effect.

16.4. If a renewal payment fails, we may retry the charge and/or suspend Plan benefits until payment succeeds; if payment continues to fail, the Plan is cancelled.

16.5. Refunds relating to Plans are governed by the Refund Policy.

17. Promotions, Coupons, and Referral Programs

17.1. Coupons, discount codes, bonus Credits, and referral rewards are subject to the specific conditions published for each campaign (eligibility, validity period, usage limits, exclusions). Unless stated otherwise: one coupon per order; coupons have no cash value, are not refundable, and are not reissued after expiry; and the discounted amount (not the face value of the coupon) is the basis for any refund calculation.

17.2. We may withdraw or modify a promotion prospectively at any time, and may void benefits obtained through multiple accounts, false information, self-referral, or other abuse.

18. Cancellations and Refunds

Cancellations of Bookings, Credit purchases, and Plans — including your statutory 7-day withdrawal right under the Act on Consumer Protection in Electronic Commerce, product-specific cancellation ladders, weather and force majeure rules, and refund processing times — are governed by our Refund Policy, which forms part of these Terms.

19. AI Services

19.1. The AI Concierge generates responses automatically using large language models operated by third-party AI providers. AI-generated responses may be inaccurate, incomplete, outdated, or unsuitable for your circumstances, and are provided for general informational purposes only. They are not professional advice and are not statements or commitments of the Company unless separately confirmed by our staff in writing.

19.2. You should independently verify time-sensitive or consequential information — opening hours, prices, transport schedules, entry and visa requirements, health and safety guidance — before relying on it. Where a Booking, payment, or safety matter is involved, the confirmation issued through the Services or the statement of our human staff prevails over AI chat output.

19.3. Do not use the AI Concierge for emergencies. In an emergency in Korea, dial 112 (police) or 119 (fire and ambulance); for tourist assistance, 1330 (Korea Travel Hotline).

19.4. You must not use the AI Concierge to generate unlawful or harmful content, to attempt to extract system instructions or underlying model behavior, or to circumvent usage limits or safety measures.

19.5. Conversations with the Concierge Agent may be reviewed by our staff for session handover, quality assurance, and complaint handling, and are processed as described in the Privacy Policy.

20. Communications

20.1. By using the Services you consent to receive transactional communications (booking confirmations, changes, payment receipts, security notices, policy notices) via the Website, email, and your linked messaging channel. These are part of the Services and cannot be opted out of while you hold an account or active Booking.

20.2. Marketing communications are sent only with your prior consent, which you can withdraw at any time via the unsubscribe link, account settings, or support. Withdrawal does not affect transactional communications.

20.3. Communications through LINE and WhatsApp are additionally subject to those platforms' terms; if a platform blocks or discontinues our channel, we will use your other registered contact details.

21. Acceptable Use

You must not, and must not assist or permit any person to:

21.1. provide false information, impersonate any person or entity, or misrepresent your affiliation with any person or entity;

21.2. circumvent the platform, including soliciting, offering, or accepting payment outside the Services for a service discovered or matched through the Services, or inducing Guides or Travelers to transact off-platform;

21.3. post fake, incentivized-without-disclosure, or manipulated reviews; rate products you did not purchase; or coordinate rating manipulation;

21.4. harass, threaten, abuse, discriminate against, or defame Guides, staff, or other Members, or send unsolicited commercial messages;

21.5. upload content that is unlawful, infringing, obscene, exploitative of minors, or invasive of privacy, or that contains malware;

21.6. access, monitor, or copy any part of the Services using robots, scrapers, or other automated means, bypass robot exclusion headers or access controls, frame or mirror the Services, or place disproportionate load on our infrastructure;

21.7. reverse-engineer, decompile, or attempt to extract the source code of the Services except to the extent permitted by mandatory law;

21.8. probe or test the vulnerability of the Services except through a responsible disclosure channel we designate;

21.9. use the Services for unlicensed guiding, unlicensed accommodation or transport sales, medical patient brokerage, or any other activity requiring a license you do not hold;

21.10. use the Services in violation of applicable law, or for any purpose other than the personal, lawful use contemplated by these Terms.

We may investigate suspected violations and take measures described in Section 28.

22. Reviews and Community Content

22.1. Reviews may be posted only by Members who purchased the reviewed product, must reflect the Member's genuine experience, and must not contain content prohibited by Section 21.5.

22.2. We do not edit the substance of reviews. We may remove or hide User Content that violates these Terms, applicable law, or the rights of others, and where practicable we will notify the author of the reason. Persistent violations may lead to community-feature restrictions or account measures under Section 28.

22.3. Guides may publicly respond to reviews of their products. Disputes of fact between a reviewer and a Guide may be handled through our support process.

22.4. We may feature, translate, or excerpt reviews within the Services and in our marketing, with attribution to your display name, under the license in Section 23.

23. License to User Content

23.1. You retain ownership of your User Content. By submitting User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (including translating and reformatting), publicly display, and distribute that content for the purposes of operating, improving, and promoting the Services.

23.2. This license ends when you delete the content or close your account, except that (a) content already shared or featured may persist in copies made before deletion, (b) we may retain copies as required for legal compliance, dispute resolution, and backup integrity, and (c) the license continues for content that you posted publicly and others have re-shared within the Services.

23.3. You represent that you own or have the necessary rights to your User Content, including the consent of identifiable individuals appearing in photos or videos, and that your User Content does not infringe the rights of any third party.

24. Copyright and Infringement Complaints

If you believe content on the Services infringes your copyright or other rights, send a notice to partnership@koncierge.co.kr identifying (a) the work claimed to be infringed, (b) the location of the allegedly infringing material, (c) your contact information, and (d) a statement, under penalty of applicable law, that you are the rights holder or authorized to act for them. We will review notices, take down content where required under the Copyright Act of Korea and other applicable law, notify the poster, and process counter-notices as the law provides. Repeat infringers' accounts may be terminated.

25. Company Intellectual Property; License to You

25.1. The Services — including software, design, text, graphics, logos, editorial content, data compilations, and the "KOncierge" name and marks — are owned by the Company or its licensors and are protected by copyright, trademark, and other laws.

25.2. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. No other rights are granted. You may not use our marks, or the marks of Guides, without prior written permission.

25.3. If you send us feedback or suggestions, we may use them without restriction or obligation to you.

26. Third-Party Platforms and Links

The Services interoperate with third-party platforms and services — including LINE, WhatsApp, payment providers, and map services — and may contain links to third-party websites. Those platforms and sites are governed by their own terms and privacy policies, we do not control them, and we are not responsible for their content, availability, or practices. References or links do not imply endorsement.

27. Privacy

Our collection and use of personal data — including account data, chat content, cross-channel linking, payment records, and analytics — is described in the Privacy Policy. By using the Services you acknowledge the processing described there; where consent is the legal basis, it is collected separately as required by Korean law.

28. Suspension and Termination

28.1. By you. You may close your account at any time by contacting support. Closure does not affect Bookings already in progress unless separately cancelled under the Refund Policy; unused paid Credits are handled under the Refund Policy; and statutory record-retention obligations continue to apply as described in the Privacy Policy.

28.2. By us — for cause. We may issue warnings, remove content, restrict features, suspend, or terminate your account where: you materially breach these Terms; you engage in fraud, review manipulation, platform circumvention, or abuse of staff, Guides, or Members; your account is used unlawfully; or we are required to do so by law or competent authority. For minor, curable breaches we will first give you notice and a reasonable opportunity to cure. For serious breaches (fraud, safety threats, unlawful activity), we may suspend immediately and give notice afterwards.

28.3. Effect. On termination for cause by us, your license under Section 25.2 ends, and Credits obtained through the conduct that caused the termination may be voided. Credits and paid amounts unrelated to the misconduct are handled under the Refund Policy. You may object to a measure taken under this Section through support, and we will review objections in good faith.

28.4. Dormant accounts. If your account is unused for a continuous period specified in our privacy practices, we may separate or delete it after advance notice as required by law, subject to the treatment of remaining Credits described in the notice.

28.5. Sections which by their nature should survive termination — including payment obligations, Sections 12, 13, 19, 23, 24, 25, and 29–36 — survive.

29. Disclaimers

29.1. To the maximum extent permitted by law, the Services are provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

29.2. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free; that information obtained through the Services (including AI Concierge output and Guide listings) will be accurate or complete; or that defects will be corrected within any particular time.

29.3. We are exempt from responsibility for failures to provide the Services caused by natural disaster, war, government action, telecommunications carrier failure, or other force majeure, and for interruptions attributable to a Member's own fault.

29.4. Nothing in this Section limits the Company's responsibilities as seller of KOncierge Travel Products, our statutory obligations as a marketplace intermediary, or any warranty or liability that cannot be disclaimed under applicable law.

30. Limitation of Liability

30.1. For Marketplace Products, the Guide, as seller, is responsible toward you for the product; the Company's responsibility is limited to its own obligations as platform operator and intermediary (including proper display of seller status, payment handling, and the processes it has undertaken in these Terms and the Refund Policy).

30.2. To the maximum extent permitted by law, the Company is not liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenue, goodwill, or data; or (c) damages arising from your dealings with third parties (including Guides, other Members, and third-party platforms), in each case even if advised of the possibility.

30.3. To the maximum extent permitted by law, the Company's aggregate liability for all claims arising out of or relating to the Services in any 12-month period will not exceed the greater of (a) the total amount you paid to the Company for the Services in that period and (b) KRW 100,000.

30.4. Nothing in these Terms excludes or limits liability for: death or personal injury caused by our negligence; damage caused by our intent or gross negligence; or any liability that cannot be excluded or limited under the laws of the Republic of Korea or the mandatory consumer protection laws of your place of residence.

31. Indemnification

You agree to defend and indemnify the Company and its officers, employees, and agents against claims, damages, and reasonable costs (including attorneys' fees) brought by a third party arising out of: your breach of these Terms; your User Content; your violation of law or of a third party's rights; or your conduct during a tour — except, in each case, to the extent caused by the Company's own fault. We will notify you of any such claim and may participate in the defense at our own expense.

32. Force Majeure

Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, riots, government orders, labor disputes, and failures of power or telecommunications infrastructure, provided the affected party resumes performance as soon as reasonably possible. Payment obligations for services already delivered are not excused. Consequences of force majeure for Bookings are set out in the Refund Policy.

33. Governing Law and Dispute Resolution

33.1. These Terms and any dispute arising out of them or the Services are governed by the laws of the Republic of Korea, excluding its conflict-of-laws rules — provided that, if you are a consumer habitually resident in another jurisdiction, you additionally retain the protection of any provisions of that jurisdiction's law that cannot be derogated from by agreement.

33.2. We encourage you to contact support first: most issues are resolved there. Formal complaints will be answered within the timelines required by Korean e-commerce law.

33.3. You may also apply for dispute mediation with the Korea Consumer Agency (kca.go.kr, call center 1372), the Electronic Commerce Dispute Mediation Committee, or the Personal Information Dispute Mediation Committee (for privacy matters), before or instead of court proceedings.

33.4. Subject to mandatory law (including consumer jurisdiction rules), the courts of the Republic of Korea have jurisdiction, with the Seoul Central District Court as the agreed court of first instance.

34. Notices

We may give notices through the Services (banners, in-product notices), by email to your registered address, or via your linked messaging channel; notices of general application may be given by posting within the Services for at least 7 days. Notices to the Company should be sent to the contact details in Section 38 or partnership@koncierge.co.kr.

35. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you and without prejudice to your accrued rights (including Credits and Bookings).

36. Miscellaneous

36.1. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision is replaced by a valid one that most closely reflects its intent.

36.2. No waiver. A failure to enforce any provision is not a waiver of the right to enforce it later.

36.3. Entire agreement. These Terms, together with the documents incorporated by reference, are the entire agreement between you and the Company regarding the Services and supersede prior agreements on the same subject, except any separate written agreement you have signed with us (for example, a Guide agreement).

36.4. Interpretation. Headings are for convenience only. "Including" means "including without limitation."

36.5. Relationship. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and the Company, or between the Company and any Guide.

37. Language

These Terms may be published in multiple languages for convenience. In case of any inconsistency between versions, the Korean version prevails to the extent of the inconsistency.
